We recently had a terrible experience with Brian Fogarty. He has been very elusive and unwilling to answer questions my brother and I have had for him. My mother made the mistake of hiring him before she passed and he seems to have no answers for any important questions. He took 10% of the value of my Mother's estate and I still haven't seen any documentation of what he did or even a copy of my Mother's will. At probate court, he told the judge and us that we were the sole beneficiaries, yet someone else inhereted my mother's $20,000 vehicle. When we asked about it after the fact, he told us there must have been a special note about the vehicle. Must have been??? He also said that the executor declares the value of the estate! Wouldn't my mother have done that when she hired him? We both requested documents from her medical history because the state of RI took 25% of her estate. We both requested a copy of the will. It has been weeks and as of today we have received nothing that we requested! When I spoke to him on the phone he gave me the run around about every question I had. He kept saying I have to go! If I could give 0 Stars than I would have! In regards to Brian's response, clearly I am not a client, I am the son of his client who passed away last year. When he says opposing side he's 100% lying as he was representing my family and my mother's will which are the same side. The opposing side was the state of Rhode Island, and considering my mother was paying him I would hope that he's not implying that he was on the side of the state of Rhode Island! Brian sent a letter to the state of Rhode Island contesting the fact that they were seeking 25k from my mother's estate from past medical expenses. Brian withdrew his contestation as soon as the state of RI sent him a packet of dates and amounts from 2015 to 2018. Brian failed to do his job as I later received a screenshot from my mother's partner regarding the medical billing. My mother's name was not even spelled correctly on the list, there's no social security number on there and he withdrew before even making a phone call to find out if they had the right person! Brian literally sat at the table with the Probate Judge, my brother, the executor, and myself and told the judge in front of all three of us that my brother and I were the only beneficiaries! My brother and I have a good relationship with my mother's partner and she was just as surprised by much of this as we were. My brother spoke with him on the phone before I did and he also said Brian would not take the time to explain anything to him. When he says opposing sides, he's either straight lying or does not know what he's talking about because he hasn't looked at the case! Finally, Brian is the one who hung up the phone on me because he didn't want to explain anything to me when I did call. That was probably because he had already taken his $7,700 and felt his job was done. I asked him how could I get a copy of the will to which he replied I could either go to City Hall or he could mail me one. I then asked if he could mail a copy to my brother and I to which he replied yes. Still haven't received it and now have to go to City Hall. I then said as far as the questions I have if you're not willing to take the time to explain things to me then maybe I will just have to have another attorney contact him. His response was go for it and then he disconnected!
