Subject: Summary of My Experience and Concerns Regarding My Trucking Company Accident Case My name is Tina Barnett, and I am writing to provide a factual summary of my experience involving the hit-and-run accident caused by a commercial truck, and the handling of the insurance and legal process that followed under the representation of Attorney Nicola Serianni at Simon & Simon Law. On the date of the accident, my vehicle was struck by a truck whose driver fled the scene. The truck was affiliated with a trucking company, and I pursued a claim regarding my injuries and damages related to the hit-and-run. During the course of my case, I experienced several issues that left me feeling confused, rushed, and unsupported. Throughout the representation by Simon & Simon Law, including communication with Attorney Nicola Serianni, the following concerns arose: I was given different settlement figures at different stages of the case. The mediator presented a range of $4,000 - $45,000. Later, I was told that the judge had indicated a maximum amount of $35,000. Despite these earlier figures, the case ultimately concluded with a $20,000 settlement, an amount I personally did not agree with. I repeatedly requested explanations and clarifications, including: A breakdown of punitive damages How the $20,000 figure was determined Why certain issues were not addressed I also asked that DocuSign not be used without my permission, but documents continued to be sent or executed without prior approval from me. As the case approached the end, especially within the last two months, the process felt rushed, which limited my ability to ask questions or properly understand key decisions. During the settlement hearing, the judge stated that he could not retry the case. I asked whether it made a difference if I signed the settlement or if he signed it, and I was told that it did not matter. Because I did not agree with the settlement amount, I stated that I preferred the judge to sign instead of me. Prior to this, I made several attempts to obtain assistance and clarity, including contacting senior counsel and later reaching out to a disciplinary office, because many of my concerns were not addressed by Simon & Simon Law. Despite my repeated requests for answers, I often felt dismissed, and at times I felt my questions were viewed as redundant -- even though my case involved a serious situation where a truck driver hit my vehicle and fled the scene. My purpose in sharing this summary is not to accuse anyone of wrongdoing, but to accurately document my personal experience and the challenges I encountered during this process.
