I was recently made aware that an attorney who represented me from this flrm six years ago had suffered a 'mini stroke' after my initial meetings with him, and before my hearing dates the following year. A different client he represented in a malpractice case in the weeks following his stroke, complained that this attorney suffered a substantial decline in ability, specifically failing to notify him of an offer made by the plaintiff to settle the lawsuit. Dughi Hewit and Domalewski is currently being sued by this former client,
After the mini stroke, this attorney had great difficulty organizing a legal strategy, and memorizing information that was essential in my case. During the first day of my hearing in April 2019, I found him to be forgetful, scattered, and unfocused, at one point referring by the wrong name. His struggles became so obvious, I had to ask for a pause in the proceedings to question him away from the judge. As with many brain injured individuals, he could not recognize his limitations.
The following day, I called the firm, and spoke with a senior partner. After hearing my concerns, he stated in a dismissive tone, "I'll go see if his brain is okay". I stopped him and emphasized the importance of the issues at hand. Then I asked for an additional attorney to attend subsequent appearances in front of the judge, but this partner refused.
This firm's treatment of that attorney was callous and cruel. To put him in a position where he was obviously unable to perform competently only added to his sense of inadequacy and humiliation. Sadly he retired within days of my hearing, and never returned to the practice of law. This firm sought to only protect itself in denying any of the concerns I raised with them, and I would not have known about the neurological problems suffered by this attorney had I not recently read it in the news.
