Last fall my father moved to Austin Minnesota from Seattle. My dad was 82 at the time of his move. He decided to buy a condo. Because of my dad's age and his health we decided that in our best interest I would be on the purchase for the home as well as my Father.purchased from a private seller.. we explained to the private that we wanted to go buy together to avoid having the house go into probate at the time of my father's death.. the private seller wusing Hoversten Johnson Beckmann law office law office law office so we decided to use them as we'll . At no point did a lawyer ever talk to us about the different contracts in the state of Minnesota. We signed a contract for a co-ownership of versus a dual ownership forr the property. We were not educated on the differences between co-ownership and dual ownership by any of the lawyers at the law office.. we signed a co-ownership for a property versus a dual ownership. A co-ownership means that I own 50% and my father owns 50% of the property. At the time of death my dad's percentage goes into probate which is exactly what we didn't want to have happen & this is the whole reason that we hired an attorney to write the contract in the 1st place. If the contract would have been written up as a dual ownership then at the time of death I would be the only owner of the property and I would not have to have the property go into probate. At no time did any of the lawyers educate us on the differences of the two different contracts so that we would have the knowledge to choose a dual ownership versus a. Co ownership.. I called and spoke to the law firm it took.several days for somebody to call me back.. I finally got a hold of Matty one of the lawyers at law office. I explained to him how no one educated us about the two different contracts in the state of Minnesota and now because I was not educated on the two different contracts my dad's house will have to go into probate. Marty just kept saying well you and your father signed a contract and we are not negligent because you didn't understand the contract that you and your father were singing.
We went there to get some advice about a certain subject, and they gave us a lawyer that has much knowledge on the subject, so as soon as we get back to her with some information, I am sure we will get a good answer to our questions. The outcome so far is better than we had hoped.
