I want to share my personal experience to help others protect their elderly family members when doing will or trust planning. My grandmother was 91 years old and had worked for the City of Cartersville, GA for over 30 years. She only knew attorney Helton who prepared her will and trust for approximately 6-9 months before she passed away. This attorney named himself: * Sole beneficiary of her Edward Jones account (over $1 million) * Medical proxy * Executor of her will The majority of these assets were left to grandmother from my Uncle who passed away almost two years prior to the day. My uncle never knew Attorney Helton and would have never left his life savings as Union Carpenter to. Attorney Shep Helton also serves on the boards of at least two organizations listed in her will. All family members were removed from the will during this process. I was never in the will and never wanted anything -- only some family photos. The day after my grandmothers funeral at Parnick and Jennings's Funeral Home Attorney Shep Helton broke into my grandmother's home, going through her personal belongings, claiming to be looking for the will (which he already had in his possession). I contacted the Bartow County Sheriff's Department, who came to the property and removed him from the property. I have video footage of this incident, Ring Camera and also body cam footage from Bartow County Sheriffs. Attorney Shep Helton used this time to speak with the deputies about his new truck. Please see listed pictures of Shep Helton entering and inside my grandmothers home the day after her funeral. Multiple independent attorneys I spoke with afterwards said they personally would never put themselves in these positions due to the conflict of interest, and expressed that the conduct appeared highly unethical. My takeaway: When doing estate planning with elderly loved ones, have multiple trusted family members or neutral third parties involved. Make sure all documents are reviewed by an independent attorney. Elderly individuals can be vulnerable to undue influence -- even from professionals in positions of trust.
