After changes of attorneys several times. And allowed the agency to drag on without any repercussion the case lasted almost 10 years before we got an agreement in federal court. It was known the agency wouldn't comply or do it correctly, and I was told by the judge, make sure it's done correctly before you can retire or it's gonna be difficult to fix. That was a year and a half ago and the senior partner. Deborah D'Agostino dropped the ball and refuses to return emails, phone calls any communications whatsoever. I did the audit myself to prove the discrepancies her paralegal created that cover letter and here. I am still sitting a month later no response. She got paid by me and various Court winnings and drops the ball and now it's the most serious part of ruining my retirement money. The process took many years due to the nature of the Discharge Review and COVID. The Federal Practice Group provided outstanding legal guidance throughout the entire process. The lawyers simply missed huge details. Allowed the opposing lawyers to make clearly obvious false statements about facts without challenging them. Lawyers did not want to make the issue about statistics, but the issue was clearly about statistics. I would attribute this to the lawyers discomfort with statistics, but it was inexcusable. In the end, the Judge cited 100% inaccurate statistics used by the opposing lawyers verbatim in the decision. Without getting into greater detail, but Federal Practice Group lawyers allowed the opposing lawyers to get away with saying something happened at a faster rate in three different years when it did not happen at all in those three different years. If it went completely unnoticed, that would be one thing, but I tried to get them to focus on the statistics and they refused. They used a chart that was badly made and far inferior to what I made. We lost the case in large part to our inability to counteract simply false statements about statistics and that is directly attributable to the Federal Practice Group Lawyers. The statistics were on our side and they let them beat us.
