It is presented pursuant to legal authority to facilitate stated intentions and is disseminated for public knowledge. 1. Mr. W. Milam Cain complained to Judge James H. Roberts Jr. about my son and myself for having firearms on our persons while on our property. Apparently, Mr. Cain does not believe in nor support the second amendment to the United States Constitution and Article 1 Section 26 of the Alabama Constitution. 2. Mr. W. Milam Cain filed suit against my brother whom is mentally disabled. 3. A complaint was filed with the Alabama State Bar Disciplinary Commission on 9/23/24 in relation to a trespass issue which is copied below. AFFIDAVIT OF TRUTH This event occurred during the morning of October 28th, 2022. W. Milam Cain, Sr did not announce his arrival and just showed up on our property. My wife and daughter discovered him walking the property after being alerted by our dogs. He was taking pictures of the fence that we had just put up. He was taking close up pictures of how the fence was put together. He was also taking pictures of farm implements and other equipment we had sitting on our property. When my wife and daughter confronted him, he did not want to give his name nor say what he was doing on our property. He was very rude, condescending and very evasive. My wife and daughter felt threatened and called me. I had to leave work and come home. When I showed up, he finally gave his name but would not say what he was doing or who he was working for. My wife's sister was visiting from out of state and this upset her for over a couple of days. She has stage four cancer. He tried to take pictures of our license plates and VIN of our vehicles. He was using the color of the law to say he was not trespassing. There was a problem with our deed which has now been corrected. He was using this as an excuse to harass us. I did not have clear title to the strip of land even though my family has been paying the property tax on said land for over 30 years. He was trespassing as he did not have permission from the title holder which our family has known for over 50 years to be on the property. He was asked to leave multiple time but refused. My wife and daughter will also testify that these statements are truth.
